Legal & effective methods of eviction once all else has failed : eviction order through the court or Rental Housing Tribunal (costly and time consuming), illegal lockout by landlord (can this process be legal if agreed to by both parties in the lease agreement). Is there an online resource where can tennants be blacklisted?

We moved into a property without a lease agreement as friends of ours were originally in the property. However the agency, in Kloof Street Cape Town, (who is acting on behalf of the landlord) recently informed us that we were occupying the property illegally despite the fact that we have been there for more than 12 months and that we have been paying rent? Could you clarify whether we are in fact "illegal tenants" as the Act appears to indicate that illegal tenants are tenants who are "squatting' or occupying land without payment of an agreed rental amount. I signed a 1yr corporate lease with an agent who always short pays me and always late. He also damaged my property by getting a plumber in to fix a leaking shower (without my consent) and the shower is still leaking. There are holes in the outside walls, the ceilings etc., and it has just been left like that and passed onto me! When questioned re short payment, his response, in writing was that his management fee is 14% plus VAT on monthly rental!!!! How can I fire him and get the corporate to pay me directly?

Thank you for the Calculating Residential Investment Deals course. I found it helpful and informative. I would recommend it not only to beginners but also to experienced Estate Agents. Although I have many years of business experience and I was expecting the course to be basic and not worth the time and effort, categorically I was wrong, the basics were refreshing and well worth the time spent, but there were many ideas that where new to me. What I derived from the course was the interaction with the other course participants, which one can learn from and also network with in the future. The course itself is an eye opener especially if you want to run with the letting process from start to finish yourself. The legal aspects I found very much as the most important part of the course.

The detail of the course also spells what to do on a step-by-step basis to reduce the letting process risk to a minimum though there is no guarantee that your investment will be looked after by the tenants. Ideas on where the letting market is and how to go about dealing with your tenant, was also of great value.
